Website Terms of Use & Accessibility

Last Updated: September 30, 2026

Acceptance of the Terms of Use

These terms of use are entered into by and between You and Clarity Point Psychiatry ("Company," "we," or "us"). The following terms and conditions ("Terms of Use") govern your access to and use of claritypoint-psychiatry.com, including any content, functionality and services offered on or through claritypoint-psychiatry.com (the "Website"), whether as a guest or a registered user.

Please read the Terms of Use carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms of Use. If you do not want to agree to these Terms of Use, you must not access or use the Website.

Important Health and Emergency Information

The Website provides general information about Clarity Point Psychiatry and mental health services. It does not provide individualized medical advice, diagnosis, or treatment. Do not use website content to start, stop, or change medication, or to delay seeking professional care.

This Website, appointment request forms, email, fax, and routine messages are not emergency services and are not continuously monitored. If you have a medical emergency or are in immediate danger, call 911 or go to the nearest emergency department. For suicide or mental health crisis support in the United States, call or text 988. Do not wait for a response from this practice during an emergency.

No Provider–Patient Relationship Through Website Use

Viewing this Website, submitting an inquiry, requesting an appointment, or receiving an automated response does not by itself establish a provider–patient relationship or guarantee acceptance into care. A relationship is established when the practice accepts you for care in accordance with applicable law and clinical procedures. An appointment request is not a confirmed appointment until the practice confirms it. This provision does not alter an existing provider–patient relationship.

Telehealth Availability and Patient Location

Clinical services are available only where the treating clinician is licensed or otherwise legally authorized to practice and where all other applicable requirements are satisfied. You must accurately identify your physical location at each telehealth visit and notify the practice of travel or a change in location before receiving care. An appointment may need to be rescheduled if you are in a location where services cannot lawfully be provided.

Telehealth requires separate informed consent and may not be appropriate for every patient or condition. Technical interruptions, limited examination capabilities, privacy risks, and the need for in-person evaluation may affect care. Appropriate alternatives will be addressed through the clinical consent and treatment process. Prescriptions, particular medications, and treatment outcomes are not guaranteed; prescribing depends on clinical judgment and applicable law.

Communications and Sensitive Information

Use the practice-designated secure patient portal or other approved clinical communication method for treatment questions and sensitive health information. Do not submit detailed medical histories, Social Security numbers, payment card information, or other unnecessary sensitive information through general website forms or ordinary email. Unless a form is expressly identified for secure clinical use, limit submissions to basic contact information and a general appointment request.

Ordinary email and text messaging may involve privacy and security risks. Any electronic communication preferences, required consent, and clinical messaging expectations will be addressed separately. Submitting contact information does not authorize unrelated marketing messages. No response time is guaranteed by these Website Terms; existing patients should follow the practice’s clinical communication instructions.

Age and Authority to Submit Information

General appointment inquiries and account registration are intended for adults age 18 or older, or a legally authorized representative acting for a patient. Minors who may independently consent to services under applicable law should contact the practice through an approved channel to discuss access. This Website is not directed to children under age 13. Do not submit information on behalf of another person without legal authority. These provisions do not eliminate rights granted to minors under applicable law or define which ages the practice treats.

Fees, Insurance, and Good Faith Estimates

Fees, insurance participation, payment arrangements, and cancellation or missed-appointment policies are provided separately and should be confirmed before scheduling. Website descriptions do not guarantee insurance coverage or reimbursement. Any financial obligations are governed by the disclosed financial agreement and applicable law.

You have the right to receive a written Good Faith Estimate of expected charges in accordance with federal law, including when you request one and when required after scheduling care. If a bill from a provider is at least $400 more than that provider’s Good Faith Estimate, you may qualify for the federal patient–provider dispute resolution process. Keep a copy of your estimate. For details, visit https://www.cms.gov/nosurprises or contact the practice. This general notice is not your individualized estimate and does not replace the practice’s separate, prominently displayed Good Faith Estimate rights notice.

Accessibility

If you have difficulty accessing website information, forms, or services, contact us using the information below so we can discuss an accessible alternative or reasonable accommodation as required by applicable law. Website use does not waive rights to nondiscrimination, effective communication, or language assistance where applicable.

Changes to the Terms of Use

We may revise and update these Terms of Use from time to time in our sole discretion. Changes apply prospectively from the updated date shown above, except as otherwise required by law. We will provide additional notice or obtain consent when required by law. Revisions do not retroactively change accrued rights or obligations.

Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Accessing the Website and Account Security

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.

You are responsible for both:

  • Making all arrangements necessary for you to have access to the Website.

  • Ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and comply with them.

To access the Website or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. Information submitted through the Website is handled under applicable law and the applicable privacy notices. Website use does not constitute a HIPAA authorization or consent to unrelated uses of health information.

If you choose, or are provided with, a user name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your user name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

Disclaimer of Warranties

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

YOUR USE OF THE PUBLIC INFORMATIONAL WEBSITE IS AT YOUR OWN RISK. THE PUBLIC INFORMATIONAL WEBSITE AND ITS EDUCATIONAL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE WEBSITE, ITS CONTENT OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING APPLIES ONLY TO THE PUBLIC INFORMATIONAL WEBSITE, NOT TO CLINICAL SERVICES OR OUR DUTIES TO PATIENTS. IT DOES NOT AFFECT ANY WARRANTIES OR RIGHTS WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

To the extent permitted by applicable law, Clarity Point Psychiatry and its website service providers are not liable for indirect, incidental, special, or consequential losses arising from use of the public informational Website, such as interruptions or reliance on general educational content.

This provision applies only to use of the public informational Website. It does not limit responsibility for clinical care, professional negligence, personal injury caused by our conduct, fraud, willful misconduct, gross negligence, violations of privacy or data-protection law, or any liability or remedy that cannot lawfully be excluded. Nothing in these Terms waives patient rights or releases us from our professional duties.

Applicable Law and Disputes

These Terms and website-related disputes are subject to applicable federal and state law, including mandatory protections that apply in your state. These Terms do not select an exclusive court, require arbitration, shorten any statutory claim deadline, waive a jury trial, or waive the right to submit complaints to licensing boards, privacy regulators, or other government agencies. Jurisdiction, venue, and filing deadlines are determined under applicable law.

Waiver and Severability

No waiver by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Clarity Point Psychiatry with respect to public website use and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

Separate Clinical Agreements

Patient intake documents, informed consent, telehealth consent, financial agreements, and applicable privacy notices address their respective subjects separately. These Terms do not replace those documents. If a conflict concerns clinical care, the applicable clinical agreement and governing law control. Your use of this website does not establish a provider–patient relationship with Clarity Point Psychiatry LLC. That relationship is established through our patient intake and acceptance process. Website content is provided for general informational purposes and does not constitute individualized medical advice, diagnosis, or treatment.
